Who did I get the ticket from?
beppo AG is a software company that digitizes the processes surrounding parking spaces and provides the corresponding software.The owners, tenants, business owners and other authorized users of parking spaces are responsible for monitoring the parking spaces themselves. We call them beppo police officers. Sometimes caretakers or external security personnel also take on this task.The beppo police officers decide whether and when to issue a warning to someone who parks illegally.
Why did I receive a criminal complaint without a warning?
From time to time, it can happen that vehicle owners who have been fined receive a criminal complaint without a prior warning. There can be a variety of reasons for this. The most common causes are information blocks, address changes that were not reported to the road traffic office, or the reported driver did not pay the administrative fine.
What happens when license plates are blocked (information block)?
Unfortunately, data protection and certain road traffic authorities are increasingly restricting us in our ability to identify the owner. This means that we are unable to identify the owner of license plates with information blocks.If information is blocked, the payment deadline is automatically extended by a further 15 days and, if payment is not received, a criminal complaint is then filed with the relevant authority.The number of information blocks is increasing, including in the canton of Zurich. We therefore hope to find a practical and economical solution as soon as possible and until then we would like to point out the following again:“If you have an information block, we cannot find you. Please pay the corresponding administrative costs or contact us personally.”
What happens if the owner’s details are not up to date?
If we can determine the owner’s details but are unable to send you the letter, we will check the postal address in an additional step and, if necessary, receive your new address, which has not yet been reported to the responsible road traffic authority. However, if this step is negative, we will have to file a criminal complaint with the responsible authority if payment has not been received.
What happens if the compensation is not paid?
If the person who parked illegally does not pay the bill on time, we will send the owner a reminder, charging a processing fee and granting him a new payment deadline.
If he fails to meet this deadline, we will file a complaint against him with the relevant court in the name and with the authority of our client.
The police will first conduct a new investigation into the driver’s details.
This can result in a fine of up to CHF 2,000.00 for the person who parked illegally. The responsible single judge will decide on the amount of the fine based on the file and the text on the court order prohibiting the parking. In addition to the fine, the person who parked illegally must pay the costs of the proceedings.
The decision can be appealed within 10 days in accordance with the attached legal remedies instructions.
What happens if it is not possible to identify the owner?
For data protection reasons, it is not always possible for us to send the owner a corresponding reminder. In other words, if an owner has placed a block on information with the road traffic authority, we must file a criminal complaint immediately after the payment deadline has passed.
Why did I receive a handling fee despite having an IV parking card?
If you have an IV parking card, you are entitled to park on public land (according to information sheet point 5.2) for an unlimited period of time. The charging of parking fees in public parking lots is governed by local regulations.However, the parking concessions do not apply to privately managed parking areas such as court-ordered bans, multi-storey car parks, parking garages, etc.If you received a handling fee, your vehicle was in a privately managed parking area. Depending on the owner’s regulations, “free” parking is tolerated there or not. However, it cannot be assumed that parking is free for owners of an IV parking card.
What do the different colors of the parking spaces mean?
White zone – These parking spaces are equipped with a parking meter or a sign on which the instructions are described according to the parking regulations of the respective cities, municipalities or owners.Blue zone – Blue parking spaces are called the so-called “blue zone”. Here you need a parking disc to park.Yellow zone – These parking spaces are private property and can be marked with a corresponding prohibition by a court judge. Parking here is prohibited without express permission or is regulated by a parking regulation.
What special features apply when parking on private property?
It happens again and again that unauthorized persons park their vehicles in a private parking lot. This can be very annoying for those affected and the question arises as to how the owner can protect themselves against this. If the authorized person suddenly needs their parking space, they are entitled to have the vehicle towed away based on the civil protection of property. However, as the client, they must cover the costs.With this variant, the client therefore bears the cost risk. The costs can be reclaimed from the person who parked illegally through civil means. Protection through a judicial ban proves to be more effective. In this case, the authorized person has the choice of whether to demand compensation for the inconvenience or to file a criminal complaint. According to federal court case law, if a person parks illegally and disregards a court-ordered ban, compensation for the inconvenience can be demanded from the person who parks illegally.
Why don’t the police fine people who park illegally in a private parking lot?
Since the traffic regulations of the Road Traffic Act do not apply to non-public traffic areas, the police cannot issue fines or take any other action in a private parking lot.
Can a person who parks illegally be required to pay compensation for the inconvenience caused by ignoring the court’s ban on parking?

This includes the personnel costs required to assert civil claims, expenses for paper, postage, etc., and the keeping of simple accounts with a check on incoming payments. On the other hand, there is no entitlement to reimbursement for general measures to monitor and secure parking spaces.As the damage items in question cannot be determined precisely with reasonable effort, an estimate can be made.The person entitled has the choice of whether to claim compensation for the inconvenience caused or to file a criminal complaint. Both are also possible.
What is a fine?
Basically, a distinction must be made between whether someone is parking in a public or private parking lot.In the case of public parking lots, we speak of administrative fines, which fall under the administrative fine procedure. The catalogue of administrative fines specifies exactly which fine amounts are incurred for which parking offense.The legal situation is somewhat more complicated for private properties. A property owner can apply for a judicial ban for his property in accordance with Art. 258 of the Code of Civil Procedure. This then prohibits any third party from using the property illegally and thereby disturbing the property owner’s property. Whether someone is actually disturbed or someone else is prevented from parking is legally irrelevant. On application, the person who parks illegally can even be punished with a fine of up to CHF 2,000.If a private property is subject to a corresponding ban, people or companies commissioned by the owner can issue fines.
