General Terms and Conditions (GTC) for the Use of the beppo App
– Version as of 4 February 2026 –
These General Terms and Conditions (“GTC”) govern the use of the mobile application “beppo” (“App”).
1. Scope of Application
These GTC apply to all users of the beppo App (“User”).
Any deviating terms and conditions of the User shall not apply unless expressly agreed to by beppo in text form.
2. Subject Matter and Purpose of the App
The beppo App is exclusively intended for the recording, transmission, and management of cases relating to:
• visitors in activated parking zones and/or
• unauthorized parking in activated parking zones and/or
• fuel drive-offs at activated gas stations
(“Cases”).
The App does not provide any independent or substantial functionality unless the User has entered into a separate contractual agreement with beppo (see Section 3).
In particular, the App is not intended to:
• manage parking zones or gas stations without a contractual relationship,
• process payments,
• provide legal advice, or
• replace any governmental or legal enforcement.
3. Separate Agreement as a Prerequisite for Use
Meaningful use of the App requires that the User or the User’s organization enters into a separate agreement with beppo (“Main Agreement”), concluded independently of these GTC.
The Main Agreement governs, in particular, the cooperation regarding the management and activation of parking zones and/or gas stations, as well as the authorization to process Cases.
The App can only be used as intended after the Main Agreement has been signed and the relevant parking zones and/or gas stations have been activated.
These GTC do not grant the User any right to conclude a Main Agreement with beppo.
The legal assessment, enforcement, or further processing of Cases shall be carried out exclusively on the basis of the Main Agreement.
In the event of any conflict between these GTC and the Main Agreement, the provisions of the Main Agreement shall prevail.
4. Registration, Access, and Authorization
Registration and login are required to use the App.
The User is obliged to keep access credentials confidential and protect them from unauthorized access.
Use of the App is limited to persons authorized by the User or the User’s organization.
beppo reserves the right to block or deactivate access in the event of suspected misuse, unauthorized use, or breach of contract.
5. User Obligations
The User undertakes to use the App solely in accordance with its intended purpose and applicable laws.
The User shall provide only truthful, complete, and carefully verified information when recording Cases.
The User must ensure that they are authorized to collect and transmit the relevant information (e.g., vehicle data, timestamps, location data, images).
It is prohibited to transmit content that:
• is unlawful, offensive, discriminatory, or misleading,
• infringes third-party rights (e.g., personality or data protection rights),
• contains malicious software, or
• is abusive or manipulative.
To the extent permitted by law, the User shall indemnify beppo against all third-party claims arising from unlawful or unauthorized data collection or transmission.
The User is responsible for ensuring the technical requirements necessary for using the App (in particular compatible devices, operating systems, and internet connection).
6. Content, Data, and Case Reports
Information recorded via the App may include, among other things:
• date and time,
• location / zone / gas station,
• vehicle license plate number,
• photos or notes,
• other case-related information (“Case Data”).
The User grants beppo the right to process the Case Data for the purpose of contract performance, system documentation, traceability, and processing within the scope of the Main Agreement.
beppo does not guarantee that a reported Case will result in any specific measure, sanction, or outcome.
7. Availability and Modifications of the App
beppo strives to ensure high availability of the App but cannot guarantee uninterrupted availability.
beppo reserves the right to update, modify, restrict, or further develop the App at any time.
beppo may change or discontinue individual functions without prior notice, particularly if required for security, legal, or technical reasons.
8. No Right of Use Without Main Agreement
Without a valid Main Agreement, there is no entitlement to activation of parking zones or gas stations in the App.
beppo may refuse or technically restrict the use of the App at any time in the absence of a Main Agreement.
9. Prices and Costs
The App may be downloaded free of charge via the Apple App Store.
Any fees for beppo’s services are governed exclusively by the Main Agreement.
The User shall bear all costs for internet access, mobile data, and devices.
10. Intellectual Property
All rights to the App (including software, trademarks, logos, designs, and texts) are owned by beppo or its licensors.
The User is granted a non-exclusive, non-transferable, revocable right to use the App in accordance with these GTC and the Main Agreement.
The User may not copy, decompile, reverse engineer, or otherwise technically analyze the App, except as permitted by law.
11. Liability
To the extent permitted by law, beppo shall be liable only for damages caused by intentional misconduct or gross negligence.
To the extent permitted by law, beppo shall not be liable for indirect damages, consequential damages, loss of profit, data loss, or third-party claims.
beppo assumes no liability for the accuracy or completeness of Case Data recorded by the User.
beppo shall not be liable for damages caused by interruptions, technical malfunctions, or third-party providers (e.g., Apple, mobile network operators).
12. Data Protection
beppo processes personal data in accordance with applicable data protection laws.
The applicable privacy policy is that of the country specified in the respective Main Agreement. It is available at:

13. Termination
The User may discontinue use of the App at any time by uninstalling it.
beppo may restrict or terminate the use of the App at any time, in particular in the event of a breach of these GTC or termination of the Main Agreement.
Termination of the Main Agreement will generally result in the App no longer providing relevant functionality to the User.
14. Text Form
Any amendments or supplements to these GTC must be made in text form (e.g., by email) to be effective.
15. Governing Law and Jurisdiction
Subject to mandatory statutory provisions, Swiss law shall apply, excluding conflict-of-law rules. Subject to mandatory statutory provisions, the courts of the Canton of Zurich shall have jurisdiction.
16. Severability Clause
If any provision of these GTC is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
